Kardashian could end the divorce tomorrow if she simply gave in to Humphries’ demand to annul the marriage on the grounds of fraud.
But Kim steadfastly refuses even though she walked out on the marriage after 72 days, after reaping a bonanza from an $18 million wedding and two television specials, plus a season of material for “Kourtney & Kim Take New York.”
Humphries lawyer, Marshall Waller, is accusing Kardashian of trying to “gain a litigation advantage” by “prematurely” setting a date for a trial.
What Marshall Waller had to say: “What is really going on here is that an ‘urgency’ in the form of an apparently unplanned pregnancy, something [Humphries] had nothing to do with, is perceived by [Kim] as an opportunity to gain a litigation advantage by trying to force this court to prematurely set this matter for trial.”
Waller also suggested Kardashian was irresponsible because her pregnancy was “unplanned.”
“Indeed, why would (she) plan to get pregnant in the midst of divorce proceedings?” he reasoned in court papers, according to gossip site TMZ.
It could be because the 32-year-old reality television star heard her biological clock ticking.
Waller also took a dig at Kim’s unusual legal predicament. Because she is still technically married to Humphries, under California law he is legally presumed to be the father and could file a claim for custody if he chooses.
But Waller assured Kim the NBA star has no plans to do so.
Kardashian has yet to sit for a deposition. Humphries has a legal right to be present and wants to be at his lawyer’s side when she is questioned. But the soonest he claims he can do it is mid-May or June, according to court filings.
